  • Exterior Elevated Elements refer to structures like decks, balconies, walkways, staircases, and their railings that project from the building and bear structural loads. These components must have a walking surface more than six feet above the ground, be designed for human use, and be supported primarily by wood or wood-based materials, including their waterproofing systems.

  • SB 721 mandates inspections for Exterior Elevated Elements that are over six feet above the ground, designed for human occupancy or use, and supported by wood or wood-based materials.

  • At least 15% of each type of Exterior Elevated Element must undergo inspection. The initial inspection deadline is January 1, 2025, with subsequent inspections required every six years.

  • Owners of multi-unit residential buildings with elevated external elements—such as decks and staircases—positioned over six feet above the surrounding ground must arrange for a licensed professional to inspect these structures for safety compliance.

    • Evaluation of the current condition of exterior elevated elements.

    • Assessment of future performance and expected lifespan.

    • Recommendations for any additional inspections or repairs.

  • If the inspector finds signs that water has penetrated the waterproofing system, potentially damaging load-bearing components, they may recommend additional, more invasive testing. The decision is left to the inspector’s professional judgment, and the extent of further testing will depend on their findings.

    1. If the inspector determines that an elevated element presents an immediate safety hazard, emergency measures must be taken immediately. This could include restricting access to the element or performing urgent repairs. These actions will ensure compliance with safety requirements.

    2. If the issue doesn’t pose an immediate threat, the building owner must apply for a permit and complete the necessary repairs within 30 days of receiving the inspection notice.

  • The building owner is ultimately responsible for ensuring that exterior elevated elements are maintained in safe and proper working condition, in line with the requirements of SB 721.
